Well, that was quick.
Less than a week ago, Jamie Foxx just dropped his first single in almost four years and he’s already been hit with a lawsuit. The actor/singer’s latest DJ Mustard-produced track “Party Ain’t A Party” is now the subject of a copyright infringement claim by a singer named J Rand.
According to published reports, in a motion filed in a California court, Nontra Records, J Rand’s record label, asserts that the song was sent to the singer by DJ Mustard prior to Foxx’s release. After recording the track for his own release, the suit claims that J Rand “possessed sole ownership in the copyright of the sound recording.” While J Rand was signed with Poe Boy Records at the time, Nontra nows claims ownership as the singer’s new label.
When J Rand’s song hit the waves in California, Nontra says that DJ Mustard “went radio silent,” failing to promote the record. Foxx’s record of the same name (using the same instrumental), now also features the song’s lyrics.
“Specifically, the underlying material and Jamie Foxx’s lyrics contained in the Subsequent Work are identical to the lyrics sung by J Rand in the sound recording of the Original Work,” the lawsuit reads.
Nontra Records is seeking $150,000 from Foxx, DJ Mustard and 2 Chainz.
“DJ Mustard did not grant any rights to a third party to exploit the recording, “Party Ain’t A Party,” and, accordingly, this claim against DJ Mustard has absolutely no merit,” reps for DJ Mustard have released in a statement.
My two-cents: $150K … pay that man and keep pushing.
